How magistration and release work
After booking, the person goes before a magistrate. Texas law (Code of Criminal Procedure Article 15.17) requires this without unnecessary delay and no later than 48 hours after arrest. The judge explains the charge and the person's rights, handles any request for a court-appointed lawyer, and decides on bail.
Under Article 17.028, the magistrate makes an individual bail decision within that 48-hour window: a personal bond, a surety bond, a cash bond or, in limited situations, denial of bail. Article 17.15 lists the factors weighed, including the offense, ability to pay, community safety and criminal history.
We also serve Archer City and Archer County and Henrietta and Clay County.
Once a bond amount is set, we review it with you, you sign the agreement, and we post a surety bond with the jail. The jail then finishes its own release processing.
What to have ready
- The defendant's full legal name and date of birth
- The charge and booking number, if you have them
- The bond amount, if it has been set
- A valid photo ID for the person signing
- Payment for the bond fee, which we quote before you sign
After release
A bond is a promise that the defendant will come to every court date. The county's main courthouse line, (940) 766-8100, can direct you to the right court. Missing court can lead to forfeiture and a new warrant, so call us right away if a date is in doubt.
